CONDITIONS UNDER WHICH PERMISSION IS GRANTED TO USE PHOTOGRAPHIC IMAGES OF WORKS OF ART IN THE COLLECTION OF THE CHRYSLER MUSEUM OF ART (the “Museum”). PERMISSION IS CONDITIONED UPON ACCEPTANCE OF THESE REGULATIONS. ANY BREACH OF THESE TERMS AND CONDITIONS WILL AUTOMATICALLY RESULT, AT THE SOLE DISCRETION OF THE MUSEUM, IN REVOCATION OF USE PERMISSION.

1. All use of images must be made from photographic materials supplied by the Museum. Use of printed or other non-photographic materials is strictly prohibited.

2. The credit line, as indicated on the use form, must be in an appropriate portion of the publication, at the end credits of a film/video/TV production, or in accompanying printed matter.

3. Fees and permission apply to ONE-TIME use. Additional language editions, subsequent editions, and reuses will be considered upon application and may require fees.
Permission will only be approved for electronic publication in a format, such as CD-ROM, that is sufficiently secure to prevent unauthorized downloading, transferring, copying, and manipulation of content, with specialized technologies used specifically for digital image protection.

4. The Museum’s image must be shown in its entirety. It must not be bled or cropped in any way. Nothing may be superimposed on the image. It must be shown in full-tone black and white or full color. In print media, the image may not be on colored stock or printed in color ink.

5. Requests to use a specific detail must be approved in advance by the Museum. When a detail is used, the word DETAIL must appear in the caption with the complete credit line. Additionally, the Museum may require that the image be shown in its entirety elsewhere.

6. Color proof (prepress/or offpress) must be submitted to the Registrar’s office prior to publication, for comparison with the original, for approval and/or corrections.

7. TWO GRATIS COPIES OF THE PUBLICATION, in which the Museum’s image appears, MUST BE SENT UPON PUBLICATION to the Museum, ATTENTION: REPRODUCTION RIGHTS OFFICE. (UNLESS OTHERWISE NOTED ON THE “SPECIAL CONDITIONS” SECTION OF THE FRONT PAGE)

8. The Museum gives no exclusive rights to any publisher, author, or producer and makes no warranties or representation and assumes no responsibility whatsoever for any claims against applicant or the Museum, by an artist, his agent, estate or any other party in connection with the use of an image of works of art in the Museum’s collection. Additionally, the applicant agrees to indemnify the Museum and hold it harmless against any and all such claims. This includes copyrights infringement claims, royalty or fee demands, and/or action, including the cost thereof, arising as result of the applicant’s use of an image of works of art in the Museum’s collection.

9. Any unauthorized use of photographic materials supplied by the Museum by any person or entity, for any reason, will render applicant responsible and liable to the Museum for appropriate compensation and other costs. Regardless of whether applicant has profited or is responsible for such unauthorized use.

10. The Museum reserves the right, at its sole discretion, to refuse permission for further applications from any applicant, if in its opinion, acceptable standards of use of the Museum’s images have not been obtained or if adherence to the terms of previous contracts has not been upheld.
